Supreme Court Practice Note review – Use of Generative AI
The Chief Justice of New South Wales has issued a statement inviting the profession to make submissions in relation to Supreme Court Practice Note Gen 23 concerning Generative AI. Given the rapidly developing nature of Generative AI, the Practice Note warrants periodic review. Submissions should be directed to his Honour’s Tipstaff, Sebastian Braham, at sebastian.braham@courts.nsw.gov.au, by Thursday, 18 December 2025. The full statement is available here.

Alternative Dispute Resolution (ADR) in 2024 and Beyond – Surveying the Profession Report
In late 2024, the Law Society of NSW, in conjunction with its ADR Committee, launched a survey to better understand the profession's current and future use of ADR. The survey sought information from lawyers about their choice of ADR, including client input, use of ADR clauses, barriers to the use of ADR, and the knowledge and skills practitioners require to represent clients in ADR processes. This report presents the findings from approximately 500 legal practitioners across NSW. It is hoped that this report provides an up-to-date foundation for the ongoing development of ADR policy, practice and education. We take this opportunity to thank all the practitioners who participated in the survey.

Statement by the Chief Justice – Probate applications and court-annexed mediation
The Chief Justice of New South Wales has published a statement in relation to the Supreme Court’s response to concerns raised by the profession regarding the processing of probate and letters of administration applications. The response has included the allocation of two new Deputy Registrars, the publishing of tips regarding common requisitions, and updates to the online probate system, which has resulted in a significant reduction in processing times. The statement also notes that the time to obtain a court-annexed mediation has improved to an average of 7.5 sitting weeks. The full statement is available here.
