Statement by the Chief Justice in relation to probate applications
The Chief Justice of NSW, the Honourable Andrew Bell, has published a statement in relation to probate applications. Ongoing processes to address issues of delay include:
- appointing two new Deputy Registrars;
- reviewing requisition practices;
- developing educational initiatives; and
- exploring improvements to the online probate system.

Entitlement to practise in a Federal Court and costs implications
Part VIIIA of the Judiciary Act 1903 deals with the entitlement of legal practitioners to practise in federal jurisdictions. Section 55B(1) provides that a practitioner who is entitled to practise as a solicitor or barrister in a state or territory is entitled to practise in a Federal Court. However, section 55B(3) provides that a person is not entitled to practise as a barrister or solicitor in a Federal Court by reason of subsection (1) unless his or her name appears in the Register of Practitioners kept by the High Court. A lawyer whose name is not entered on the Register of Practitioners will only be entitled to claim costs on a party/party basis for work undertaken in a proceeding in a Federal Court at the rates prescribed for a graduate or law clerk. Uniform Civil Procedure (Amendment No 105) Rule 2025
On 7 July 2025 the Uniform Rules Committee approved Amendment No 105 to the Uniform Civil Procedure Rules 2005. The new rule amends the circumstances in which a party must obtain leave of the court before issuing a subpoena to include proceedings where:
- a party has not entered an appearance; or
- there is no defendant.

Revised Industrial Court Criminal Practice Note No. 1
The Industrial Court Criminal Practice Note 1, which applies to work health and safety prosecutions, has been revised to include case management provisions, and now annexes ‘usual directions’ for both defended hearings and sentencing hearings. The revised Note can be accessed here.
