Farewell sitting for The Honourable Justice David Davies
The Honourable Justice David Davies will retire from the Common Law Division of the Supreme Court of NSW. An informal farewell sitting will be held to mark this occasion on Friday 27 June 2025, at 9.15am in Court 12D, Law Courts Building. The Honourable John Sackar KC will move the farewell. Robes will not be worn. The sitting will be livestreamed, with a link available on the Supreme Court homepage.

25th Anniversary of the Federal Circuit and Family Court of Australia (Division 2)
The Honourable Chief Judge William Alstergren AO and the Judges of the Federal Circuit and Family Court of Australia (Division 2) invite members of the profession to attend a ceremonial sitting to mark the 25th anniversary of the Court. Multi-factor authentication is coming to ImmiAccount
The Law Society has been informed that the Department of Home Affairs will be introducing compulsory use of multi-factor authentication (MFA) for ImmiAccount on Wednesday 18 June 2025. MFA adds an extra layer of security to ImmiAccount, helping to protect users’ personal and sensitive information from unauthorised access. Legislative Assembly Committee on Law and Safety
The Law Society of NSW wrote to Opposition and Greens members in the Legislative Council ahead of the Chamber’s consideration of the Workers Compensation Legislation Amendment Bill 2025. We remain concerned the Bill, in its current form, could unnecessarily affect liability and entitlements in psychological injury claims, as well as the broader workers compensation scheme. Key issues raised in our letter include changes to lift the Whole Person Impairment threshold, the retrospective operation of the transitional provisions, the 130-week cap on weekly payments, and the impact of the joint principal assessment process. We urged the Government to return the Bill to the design stage for further consideration, for the development of a more nuanced and appropriate scheme. On 5 June 2025, the Bill was referred to inquiry for further consultation.

We now offer a straightforward path to accreditation, allowing members to distinguish themselves in the market as both practising solicitors and qualified mediators. Advocacy in action
The Law Society of NSW welcomes the Legislative Assembly Committee on Law and Safety’s Interim report: Community safety in regional and rural communities. Informed by our Criminal Law, Children’s Legal Issues, Indigenous Issues and Rural Issues Committees, our submission noted the complex drivers underlying youth justice issues, and highlighted the need to invest in early intervention measures. We are pleased to see many of our suggestions reflected in the Committee’s recommendations to the NSW Government, including increased place-based investment to support at-risk youth; co-designed early interventions for First Nations young people with Elders and communities; collaboration between the NSW Department of Education and schools in disadvantaged regions to provide supportive programs; and consideration of centres offering accommodation and alternative educational pathways. We look forward to the Committee’s Final Report on this matter in the coming months.

Industrial Relations Commission: new Practice Note and protocol
The Industrial Relations Commission (IRC) has published Practice Note 14B, which replaces Practice Note 14A. Practice Note 14B is the Usual Directions for Applications for Recovery of Money and Civil penalties and Applications under section 106 of the Industrial Relations Act 1996 (NSW). It is available on the IRC website here. The IRC has also published a ‘Protocol on the use of audio-visual links’, which is available here.

New rental laws in NSW
Rental laws in NSW have changed. Amongst other things, the changes require landlords to provide a reason to end a lease – ending ‘no grounds’ terminations for tenants. The changes also make it easier to keep a pet in a rental home. More information on these changes is available on the NSW Fair Trading website, including the new requirements for ending a tenancy available here.

Commencement of the Bail Amendment (Ban on Private Electronic Monitoring) Bill 2025
On 11 June 2025, the Bail Amendment (Ban on Private Electronic Monitoring) Bill 2025 received assent. The Bill removes the option of privately arranged and funded electronic monitoring as a bail condition. There is a transition period for accused persons who were subject to a private electronic monitoring bail condition before the commencement date of the Bill. The transition period commenced on 11 June 2025 and will end on 12 September 2025. Text of the Bill is available here.
