Foundations on which to build a thriving career

|
Newly minted lawyers start their first day in practice like a blank sheet of paper. It is the beginning of many chapters to come; a career dedicated to serving their clients and to advocating and upholding the rule of law. When the book is complete, the paragraphs in that story won’t solely be the product of their own work. There will be the contributions to a lawyer’s life-long learning from their contemporaries, supervisors, mentors and in a profession that values respect and courtesy, even by their opponents. The Law Society of NSW's Lawyer Mediator Accreditation Scheme (LMA Scheme): exclusive to solicitor members
We now offer a straightforward path to accreditation, allowing members to distinguish themselves in the market as both practising solicitors and qualified mediators. LMA Scheme membership will assure people seeking mediation that they are in the hands of an expert problem solver, someone backed by legal experience and stringent professional standards. Solicitors currently accredited as mediators, or those who have successfully completed an approved mediator training in the past six months, are invited to apply. More information can be found here.

Advocacy in action
The Law Society NSW, informed by its Environmental Planning and Development, Rural Issues and Law Society members of the Revenue NSW/Law Society Liaison Committees, has submitted on the Natural Resource Commission’s review of the NSW Plan for Nature, which aims to provide the NSW Government with options to further preserve biodiversity and ecosystems in regions while supporting landholders. Our submission supports finalising the Native Vegetation Map, reviewing the operation of the Native Vegetation Panel, and improving the monitoring and reporting of land clearing. We also raised the need to remove regulatory and insurance barriers to cultural land management and called for a whole of government approach to incentivising landholders to enter into private conservation arrangements.

Closure of Community Justice Centres
The Law Society has been notified by the Department of Communities and Justice (DCJ) that the Community Justice Centres Act 1983 (NSW) will be repealed, and Community Justice Centres (CJCs) will be closed effective 30 June 2025.
- From 1 July 2025, DCJ will only provide mediation services for matters ordered by the Courts (a court order is required, not merely a referral). The types of matters mediated will not be limited to Apprehended Personal Violence Orders. If the Court determines a civil matter is suitable for mediation, then the Magistrate can make the Order, and DCJ’s new in-house unit will provide the mediation service.
- From 1 July 2025, DCJ will accept referrals for disputes involving Incorporated Associations. These specifically relate to internal disputes (for example, between two members). Associations can choose to use the model constitution or write their own constitution. If an Association writes its own constitution and does not address a matter in the model constitution, the terms of the model constitution apply. If the model constitution applies, the dispute must be referred to a Community Justice Centre for mediation, and these referrals will be handled by the new DCJ mediation unit.
- For all other matters, parties will be referred to the LawAccess website as their starting point for resources on how to resolve their dispute.
