Advocacy in action at the Law Society of NSW: Review of the Anti-Discrimination Act 1977 (NSW)
The Anti-Discrimination Act 1977 (NSW) was once considered to be a forerunner in anti-discrimination law among the Australian jurisdictions. In a recent submission to the NSW Law Reform Commission (NSWLRC), informed by our Human Rights, Public Law, Employment Law, Indigenous Issues and Property Law Committees, the Law Society advocated that this legislation requires significant updates to reflect contemporary societal understandings of discrimination. Our submission advocates for a comprehensive and leading regime for NSW, which takes into account intersectionality and addresses systemic discrimination on the basis of protected attributes. The NSWLRC is developing a second consultation on enforcement and other procedural aspects of the ADA, and the Law Society also looks forward to engaging on these important issues.
