Submission of the week: Commonwealth Data Retention Review
The Law Society NSW, informed by its Privacy and Data Law and In-house Corporate Lawyers Committees, recently contributed to the Law Council of Australia’s submission in response to the Government’s Commonwealth Data Retention Review. The Review seeks to assess if data retention provisions balance their policy intent with cyber and privacy risks in the retention of large data holdings. Our feedback highlights present difficulties in interpreting and applying data retention provisions that contain varying requirements across legislation. To address these concerns, we support several of the Government’s proposed Principles and call for greater harmonisation of data retention requirements to avoid future ambiguity. To read our submissions, please see our Policy Submissions 2025 page.
