Advocacy in action
The Law Society of NSW, informed by our Environmental Planning and Development Committee, made a submission to the NSW Department of Planning, Housing and Infrastructure on proposed reforms to deter illegal tree and vegetation clearing. We supported proposed measures including tiered penalties; requiring certification from a qualified arborist that vegetation is dead or dying before clearing occurs; and clarifying the application of Chapter 2 of the State Environmental Planning Policy (Biodiversity and Conservation) 2021 to matters including clearing on public land. We also raised concerns about the proposal to specify detail on proven illegal clearing on planning certificates to deter illegal clearing of land.
