Advocacy in action at the Law Society NSW: the future of legally aided work
The sustainability of the legal aid sector has been under sharp focus recently following the publication of the National Legal Aid Census of Private Practitioners. The Census revealed a significant number of practitioners indicated they may not provide legally aided services next year, due to increasing difficulties in undertaking this work. While the Law Society welcomes a recent uplift of Commonwealth funding for the legal assistance sector, we are currently advocating to Government on the urgency of increasing funding for private practitioners who carry out legally aided work, given over 70 per cent of legal aid services are delivered by private practitioners. With a third of respondents to the Census based in NSW, such an exodus of practitioners would significantly limit access to justice in our state.

Industrial Relations Commission Amendment Rules 2005 (NSW)
The Industrial Relations Commission Amendment Rules 2005 (NSW) commenced on 7 April 2025, available online here. The amendments aim to facilitate the appointment of legal practitioners or agents; ensure there are written and signed case statements; and provide clear procedures for criminal appeals to the Full Bench.

Bail applications involving Mudgee Private Rehabilitation Centre
The Department of Communities and Justice has advised that on 19 March 2025, Mid-Western Regional Council refused a development application from Mudgee Private Rehabilitation Centre seeking authorisation to operate as a residential rehabilitation facility. The premises used by Mudgee Private Rehabilitation Centre may only be used as a residential dwelling.
