PRESIDENT'S MESSAGE

Staying vigilant and disciplined on the road to recovery

As restrictions continue to ease here in NSW, the weekend spike in COVID-19 cases in Victoria is a timely reminder that we must all remain vigilant and disciplined about physical distancing and good hygiene to prevent a second wave of infection. Of the 25 new COVID-19 cases in Australia in the past 24 hours, 19 of those have been in Victoria.

We are at a crucial point on the road to recovery in NSW. With the staggered resumption of face-to-face hearings in some of our state’s courts and more in the planning, we must continue to ensure that the safety of all court users remains paramount. Practising certificate renewals due by 30 June
To engage in legal practice after 30 June 2020, you must hold a practising certificate.If you have not yet lodged your renewal application, please do so here. The legal profession legislation does not permit the Law Society to accept practising certificate renewal applications submitted after 30 June 2020. Read more.
Associate membership renewals due by 30 June

Contingency plan to assist sole principals
The Law Society has launched a new resource, Contingency Plan for Sole Principals, designed to help sole principals nominate a Personal Representative and an Alternate in the event they are no longer able to manage their practice. Read more here.
Federal Court of Australia
The Federal Court of Australia will begin hearing some matters in-person from next week. The Hon James Allsop AO, Chief Justice, Federal Court of Australia, has issued Coronavirus (COVID-19) Update 24, detailing the changes to court operations. Read more.
Specialist Accreditation Conference Postponed
Due to COVID-19, the Specialist Accreditation conference has been postponed until November 2020. Dates and program to be announced soon.

Manager, Legal Assistance
The NSW Bar Association is seeking expressions of interest from experienced solicitors with a current NSW practising certificate, for the position of Manager, Legal Assistance. A background in the social justice sector is desirable. Applications close on 18 July 2020.

State Revenue Legislation Further Amendment Bill 2020
The State Revenue Legislation Further Amendment Bill 2020 passed Parliament on 18 June and commences on assent. The Bill contains provisions that clarify when a trustee of a discretionary trust (including a testamentary trust) is exempt or not liable for surcharge land tax or surcharge purchaser duty. Practitioners are alerted to the transitional provisions in relation to the amendment of discretionary trusts, and the impact on wills and testamentary trusts.  The Bill also makes significant changes to landholder duty. We understand that Revenue NSW will be providing guidance on how the provisions will operate in practice, and we’ll advise when this is available. READ MORE

Revenue NSW – Annual indexation of duties thresholds and base duty amounts
As part of the 2019 NSW State Budget, NSW Government introduced annual indexation of duties thresholds and base duty amounts (aligned to CPI). This impacts the general rate of duty and premium duty. The indexed amounts are now available on the Revenue NSW website and calculators. The indexed amounts apply from 1 July 2020 to 30 June 2021. See Division 3 Indexation of amounts of the Duties Act 1997.
