PRESIDENT'S MESSAGE
Working with Courts during lockdown and Dementia Action Week

This past week I have continued to speak with heads of jurisdiction about the feedback we are receiving from many practitioners who are struggling to prepare matters and comply with timetables during the lockdown. We appreciate that the Courts are trying to keep the wheels of justice turning whilst complying with public health orders. However, we are being told that operating in a ‘business as usual’ environment has become particularly stressful for those practitioners who have young children, are home schooling, or don’t have an appropriate working from home environment. Continue reading >

Is cyber security a priority for your legal practice?
Electronic communications are now standard business practice, but this has created new opportunities for fraudsters and hackers, and increased risk for practitioners. Commissioner John McKenzie leads a panel at next month’s FLIP Conference to help you identify and address risks and develop and maintain business processes to keep your practice safe. Early bird passes are still available for $199. See program.

New Federal Circuit and Family Court of Australia (FCFCOA)

A reminder that practitioners can access the Law Society’s webinar on the new Federal Circuit and Family Court of Australia featuring the head of the new Court, the Honourable Chief Justice William Alstergren, via the Law Society’s on demand portal. This online session provides an overview of the new structure, procedural aspects and considerations for family law practitioners. Practitioners can also subscribe for regular updates from the new Court on the new FCFCOA website.

Affidavits in the Federal Circuit and Family Court of Australia (Division 2)
Practitioners are reminded that in Table 2.1 of the Federal Circuit and Family Court of Australia (Division 2) (Family Law) Rules 2021, Items 7 and 8 limit affidavit material to 10 pages and 5 annexures. This contrasts with the limits of 25 pages and 10 annexures, which apply in Division 1.

District Court statement
The District Court of NSW has announced its plan to resume jury trials in Greater Sydney, Newcastle, Gosford and Wollongong from 25 October 2021. The District Court is the largest criminal trial court in the country and around 200 trials have been vacated since the suspension of new jury trials from 28 June 2021. Jury trials have recently resumed in some regions that have come out of lockdown but remain suspended in most of NSW. Chief Judge of the District Court, Justice Derek Price AO, says the resumption of jury trials is the next step in managing a COVID-19 backlog. Read the Court’s statement here.

Restrictions ease in LGAs of concern
NSW Premier Gladys Berejiklian yesterday announced that the restrictions in local government areas of concern will start to align with other lockdown areas in Greater Sydney, as vaccination rates continue to rise. As of today, some of the eased restrictions include: no limit on the duration of outdoor exercise and recreation (previously a two-hour limit) outdoor gatherings of up to five fully vaccinated people (not including children aged 12 and under) will be allowed in a person’s LGA or within 5km of home (previously only fully vaccinated household members could gather outdoors, or up to two fully vaccinated people from different households) and shopping, exercise and outdoor recreation can be done 5km from home or within your LGA (previously only 5km from home). Nearly all restrictions in the LGAs of concern are now aligned with other lockdown areas, with the main differences being authorised worker conditions and travel permit requirements which remain in place in the LGAs of concern.
