PRESIDENT'S MESSAGE

Resignation of Law Society CEO Michael Tidball

Today, it is my duty to announce that the Law Society’s Chief Executive Officer, Michael Tidball, will be resigning after nearly 14 years at the helm to take up a new position as Chief Executive Officer of the Law Council of Australia.

As the longest-serving CEO of the Law Society of NSW and as Secretary-General of LAWASIA in recent years, Michael has come to the view that it is timely for him to depart while the organisation is in a strong position.

Continuing Professional Development (CPD) – Statutory compliance by 31 March 2020
Practitioners are reminded that the 2019-20 CPD year concludes 31 March 2020. CPD compliance is a statutory requirement, governed by the Legal Profession Uniform Continuing Professional Development (Solicitors) Rules 2015.
It is a practitioner’s individual responsibility to maintain accurate records evidencing their engagement in CPD activities and satisfy themselves that they have properly complied with the CPD requirements, so as not to make a false declaration in their practising certificate renewal application.
Please review the Society’s CPD information to ensure that you can comply with the CPD requirements by 31 March 2020. You may search available CPD courses through LawInform.
In the special circumstances arising from COVID-19, the Law Society understands that solicitors may need to exceed the 5-unit cap on private study of audio/visual material to complete their CPD points. Please read the detailed information provided on the Law Society website.

Supreme Court of NSW and the District Court of NSW new jury trials to be temporarily suspended from Monday 16 March 2020
The Chief Justice, the Hon TF Bathurst AC, and Chief Judge of the District Court, the Hon D Price AM, have announced that due to the coronavirus (COVID-19) new jury trials commencing across NSW from Monday 16 March 2020 will be temporarily suspended while the empanelment process is reviewed and steps are taken to seek to limit the close social contact amongst jurors, which is a feature of jury trials. Current trials, where a jury has already been selected and empanelled, will continue.

The Supreme Court of NSW – upcoming changes to sitting procedures to minimise the spread of coronavirus (COVID-19)
The Court is carefully monitoring the Commonwealth and State Governments' announcements and health advice relating to coronavirus (COVID-19). The Court has also removed water glasses and jugs from the courtroom. Practitioners are welcome to bring their own water, as many already do.

Land and Environment Court of NSW – Coronavirus update
The Acting Chief Judge of the Land and Environment Court has issued updated information relating to procedural changes in light of the latest Coronavirus recommendation. The Court is no longer providing access to interview rooms and the mediation room and is also removing water glasses and jugs from the courtroom. Practitioners are welcome to bring their own water, as many already do.

Revisions and updates to the Court of Appeal website
The Court of Appeal website has been revised and updated by the inclusion of materials about Judicial Review (Supervisory Jurisdiction), available here. It is intended to be a resource for legal practitioners who are seeking to invoke the judicial review jurisdiction of the Supreme Court. The section contains information relating to the scope of reviewable decisions; grounds of review; relief; procedure; and appeals. The Court of Appeal website also contains the fortnightly decisions of interest bulletin; an annotated version of the Civil Liability Act; and other helpful resources for legal practitioners.

Clearance of a land tax charge in an electronic conveyancing settlement
With Conveyancing Rules Waiver CR3/2019 - Land Tax due to expire on 31 March 2020, practitioners should note the information published by Revenue NSW on the payment of land tax at settlement via an electronic lodgment network and clearance of the charge. See the information under the heading Apply for a land tax clearance certificate, under the subheading Electronic Lodgement Networks.
