PRESIDENT'S MESSAGE
Prioritising access to justice and the preservation of law in 2019

Welcome back to all our members and Happy New Year.

2019 is already shaping up to be an incredibly busy year for the Law Society of NSW, with both a State and Federal Election set to take place within the next six months. The last time this occurred in NSW was way back in 2007, when Kevin Rudd became Prime Minister for the first time and Morris Iemma was re-elected Premier. Unfortunately, a revolving door of political leadership has defined this past decade, causing all sorts of distractions and disruptions to the policy-making process. Which is why this year’s respective election campaigns will be an important opportunity for all political parties and candidates to re-articulate their vision for the people and communities they seek to serve. In relation to the State Election on 23 March, it is up to all of us, as the Law Society and the voice of the profession, to advocate for safeguarding rights and legal protections. The Law Society calls on all political leaders to meaningfully prioritise access to justice and upholding the rule of law.

Consultation with women in law

As part of the National Inquiry into Sexual Harassment, the Australian Human Rights Commission invites you to a targeted consultation for women working in the legal profession. This consultation will be held at the Australian Human Rights Commission on Monday 11 February. State government offers big money for big ideas

The Law Society invites claims against the Legal Practitioners Fidelity Fund by default for the following practices:
  1. Law practice Gow Group - Global Legal Services, arising from conduct of an associate of that law practice, Samantha Catherine Gow. Claims must be received by 29 April 2019. READ MORE
  2. Law practice P A Khoury Group Pty Ltd trading as PAK Law arising from the conduct of an associate of that law practice, Peter Anthony Khoury. Claims must be received by 8 April 2019. READ MORE
  3. Law practice known as Catterick Bridge and also known by the trade name Red Brick Conveyancing arising from the conduct of an associate of that law practice, James Magiannis. Claims must be received by 8 April 2019. READ MORE

PPSR seven-year registrations to expire 
Practitioners are reminded that the Personal Property Securities Register will be seven years old on 30 January 2019. Security interests with seven-year registration periods, including registrations against serial numbers and/or consumer goods  (if made in 2012) will, unless renewed, automatically expire from 30 January 2019.

Uniform Civil Procedure Rules 2005 – Rule 39.39A Amendment
Rule 39.39A of the Uniform Civil Procedure Rules 2005 was amended by the Uniform Civil Procedure (Amendment No 87) Rule 2018. The amendment increases the minimum amount standing to the credit of the judgment debtor in a financial institution before a garnishee order will operate, with the minimum amount now set by reference to section 118A (1) of the Civil Procedure Act 2005. It commenced on 7 December 2018.

Re-issued Practice Note SC Eq 4 – Supreme Court Equity Division, Corporations List
The NSW Supreme Court has re-issued Practice Note SC Eq 4 which relates to the Corporations List in the Supreme Court Equity Division. The changes include use of the Online Court in the Registrar’s List. It commenced on 18 December 2018. Read more

Service by post – Amendment to Rule 13(4)(a) Civil and Administrative Tribunal Rules 2014 (NSW)
Rule 13(4)(a) of the Civil and Administrative Tribunal Rules 2014 (NSW) was amended with effect from 21 December 2018 to provide that service by post is now taken to have been effected “at the end of the seventh working day after the date on which the notice or document was posted” rather than on the fourth working day. This is consistent with Section 76(1)(b) of the Interpretation Act 1987 (NSW).

Uniform Civil Procedure Rules 2005 – Rule 7.4 Amendment
The Uniform Civil Procedure (Amendment No 88) Rule 2018 has inserted Rule 7.4 into the Uniform Civil Procedure Rules 2005. The rule makes provision for an unincorporated organisation to appoint an entity to act as the proper defendant in proceedings for a civil claim arising from abuse against a child. The rule commenced on 1 January 2019 when Division 4 of Part 1B of the Civil Liability Act 2002 commenced. “UCPR form 162 – Consent to act as proper defendant” is available here.

Ceremony invitation: Appointment of Patricia Henry
Patricia Henry has been appointed a Judge of the Supreme Court of New South Wales. A formal ceremony to mark this occasion will be held in Banco Court at 9:15am on Wednesday 30 January. The ceremony will be followed by a morning tea in the Judges’ Dining Room on Level 13.
