'Rehabilitation, not punishment': Youth Koori Court opens in Surry Hills

It was a privilege to attend the first ceremonial sitting of the new Youth Koori Court in Surry Hills last week and to witness the expansion of a program that facilitates the direct involvement of the Aboriginal community in the administration of justice. However, the opening of the ground-breaking new facility, which was preceded with a moving Welcome to Country and smoking ceremony outside the new facility, also served as a timely reminder of the alarming statistics relating to the proportion of young Indigenous people detained in juvenile custody and the urgent need to address the systemic challenges driving our state and nation’s overwhelming rates of Indigenous incarceration. Profession Uniform General Amendment (Indexation) Rule 2019.
There has been an amendment to the Legal Profession Uniform General Rules. Rule 111A will commence on 1 July 2019 and applies indexation to amounts in ss 291-293 and s 99 of the Legal Profession Uniform Application Act 2014 (Vic). This amendment will ensure that Victorian and NSW Legal Services Commissioners and the Victorian Civil and Administrative Tribunal maintain their jurisdiction to determine costs disputes in line with inflation. Each year the Commissioner for Uniform Legal Services Regulation will give public notice on the LSC website of the actual amounts applying in each financial year resulting from indexation under this rule.

Electronic conveyancing - Version 5 of the NSW Participation Rules and NSW Operating Requirements
Version 5 of the NSW Participation Rules and NSW Operating Requirements commence on 25 February 2019. Note that Schedule 4 of the NSW Participation Rules contains revised Client Authorisation forms.

Review of the Intergovernmental Agreement (IGA) for an Electronic Conveyancing National Law – Survey
As earlier notified, solicitors are asked to complete a survey about their experience with electronic conveyancing, to provide input for the current Review. The survey closes on Sunday 17 February 2019.

Cybercrime alert
Since the last alert, the Trust Accounts Department has been notified of a further two fraud incidents. In the first, involving over $800,000, the solicitor was acting for the vendor in a conveyancing transaction and it is apparent that the hacker/s were monitoring the emails between the solicitor and the client.
