Passage of NSW workers compensation reforms
The Law Society of NSW notes the passage through NSW Parliament today of the Workers Compensation Legislation Amendment (Reform and Modernisation) Bill 2025.
The Law Society has consistently recognised that the workers compensation system is under pressure and in need of reform.
During the unusually accelerated consultation process for a legislative scheme with such potentially major impacts for injured workers and employers, the Law Society drew attention to a number of shortcomings of the bill. We proposed alternative approaches to improve systemic efficiency without compromising access to justice.
Our contributions to this process included written submissions and oral evidence before a Parliamentary Inquiry, with answers to questions on notice. The concerns and suggestions raised were not addressed or reflected in the final version of the legislation.
From a rule of law perspective, we also raised our concerns at the significant deficiencies in the consultation process. Legislation not subject to comprehensive consultation from the outset is more likely to result in unintended consequences.
Expert lawyers who volunteer on the Law Society’s Injury Compensation and Employment Law Committees will monitor the practical effect and operation of the legislation, as it is implemented, in order to assist the Government with observations around provisions that are resulting in adverse outcomes.
