PRESIDENT'S MESSAGE

Concerns over the NSW Government's CTP Scheme

The Law Society is becoming increasingly concerned that the NSW Government’s CTP Scheme is depriving people who are genuinely injured in motor vehicle accidents of appropriate benefits and compensation, despite the legitimacy and accepted reality of their injuries.

When the NSW Government’s proposal for a minor injury test was first put forward in 2017, the legal profession raised strong concerns. At the time we advocated that upholding fairness for people injured in motor vehicle accidents should be the primary objective for the new CTP Scheme. Continue reading >

2019 Law Society Council Election
Ballot papers and voting instructions will shortly be forwarded to all Solicitor Members. An email invitation to vote from our external provider, BigPulse, will also be sent during the last week in September. Solicitor Members with personalised email addresses recorded with the Law Society will again have the option of voting electronically. To vote electronically, a unique password is populated in “Your Sign-in Name” which must not be overwritten. For security purposes, you need to enter, in “Member ID”, your Law Society Number recorded on your practising certificate (or ID card). Your personalised email cannot be forwarded on. Please note – you may only vote once. If you choose to vote electronically, please do not submit a paper ballot as this will invalidate both the electronic and paper votes. Native Title External Mediator Review: Expressions of interests
The Federal Court of Australia intends to review and update its list of suitably qualified mediators to assist the Court in the management of its native title work. The Court has extended an invitation to Law Society members to review the requirements for this role and, where appropriate, express an interest in joining this list. This process is conducted bi-annually and previous mediators who are currently on the Court’s approved mediator list are invited to re-apply. General invitations are extended to new applicants. READ MORE

Consultation for draft Authorised Nominating Authorities (ANA) code of practice under security of payment legislation
The Building and Construction Industry Security of Payment Amendment Act 2018 (the Amendment Act) creates the ability for the Minister to gazette an enforceable code of practice for Authorised Nominating Authorities (ANA). A new code of practice has been developed for consultation. Consultation will be open from Monday 16 September, concluding on Friday 4 October 2019. READ MORE

Family law practitioners are reminded, when filing an application for final orders, to consider the Protocol for the division of work between the Family Court of Australia and the Federal Circuit Court. The Protocol sets out eight criteria which indicate when an application for final orders should ordinarily be filed and/or heard in the Family Court of Australia, judicial resources permitting. Applications that fall outside these criteria should ordinarily be filed and/or heard in the Federal Circuit Court

Access to digital assets upon death and incapacity: NSW Law Reform Commission Review
At the request of the NSW Attorney General, the NSW Law Reform Commission is undertaking a review of the laws that affect access to a NSW person’s digital assets and digital records after they die or become incapacitated.  As part of the review, the Commission is surveying lawyers on how they advise clients about managing their digital records and digital assets after they die or become incapacitated.  If you would like to participate, the survey is available here.
