PRESIDENT'S MESSAGE

The need for transparency in the supply chain

A new Australian film, Buoyancy, which draws from the real-life experiences of some of the estimated 200,000 men and boys working in slave-like conditions in the Thai fishing industry, is playing an important role in raising awareness of the need for transparency in the supply chain.

The makers of the film, which is screening in cinemas around the country, have admitted that like most Australians they knew nothing about the slave trade in the fishing industry before they read the script for the film. Since making the film, they have joined calls for the Australian Government to implement a certification standard so consumers can be certain that imported seafood is slavery free. The film has recently been announced as Australia's entrant for ‘best international feature’ in next year's Oscars. Continue reading >

2019 Edition of the contract for the sale and purchase of land
We understand the Government’s off the plan reforms are expected to commence on 1 December 2019. Once the final form of the amending regulation implementing the changes is published, which is expected to occur within coming weeks, we will publish a new edition of the contract for sale and purchase of land. Final publication dates will be announced in Monday Briefs. The Office of the Registrar General has also published information in relation to the off the plan reforms, including the content of the new disclosure statement.

Changes to Legal Aid NSW Eligibility Policies: Elder Abuse
The Legal Aid NSW Board approved changes to the Means Test, and civil and family law policies, to clarify that legal aid is available for people who are experiencing, or at risk of, elder abuse. The changes include amending the definition of an ‘older person’ to 65 years, or 55 years for Aboriginal and Torres Strait Islander people, and clarifying that legal aid is available to protect an older person’s interest in property in circumstances where there is elder abuse. The new policies apply to applications determined on or after 1 October 2019. Please see Policy Bulletin 2019 No.12 for more details.

Change in interest rate on unpaid legal costs
At its meeting on 1 October 2019 the Reserve Bank of Australia reduced the cash rate by 0.25 basis points to 0.75 per cent. Accordingly, the interest rate on unpaid legal costs pursuant to Rule 75 of the Legal Profession Uniform General Rules 2015 on unpaid legal costs for bills issued on and from 2 October 2019  is now 2.75 per cent.

Change to the Strata Schemes Management Act 2015
New section 132A of the SSMA, which limits the term of certain agreements for supply of electricity, gas or other utilities in strata schemes, commenced on 1 October 2019.

NSW Electoral Commission: Information required to be disclosed on the Register and recent amendments to the Regulation
The Commission wishes to draw attention to two matters of general interest about the information in the Register. Recent amendments to the Regulation have also extended the information required about clients to be included in the Register from 1 July 2019. The Commission is concerned that third-party lobbyists and professional services firms take care to understand the scope of their obligations under the Act and Regulation. Download media statement
