Unto the breach

Optus announced the unauthorised disclosure of data on 22 September. The nature and extent of what data has been stolen is still being ascertained, but in some cases the passport and drivers’ licence numbers, Medicare numbers, addresses and date of birth of customers have been exposed and held to ransom. Read more

 
Barriers to support
In recent years workplace, mental health programs have come to the fore as employers have begun to recognise the direct link between mental health, professional outcomes and corporate success. Perhaps this is due, in part, to the emerging evidence. For instance, as recently as July 2022, the ABS released a set of sobering statistics indicating that over 2 in 5 adult Australians (43.7 per cent) experience a mental disorder in their lifetime.

Proceed with caution
Since the repeal of s 51(3) of the Competition and Consumer Act 2010 (Cth) (‘CCA’) in September 2019, conduct involving specified intellectual property (‘IP’) rights is no longer exempt from key prohibitions in Part IV of the CCA.

A delicate balancing act
Once upon a time, passwords were written on a sheet of paper, kept inside a manila folder, and tucked away in a filing cabinet.
For the very brave, the handful of important combinations of numbers, letters and symbols were folded inside a wallet. Chances are the passwords were loose adaptions of each other, but under no circumstances could they include clues to birthdays or addresses.

The ethical obligation of lawyers to maintain the confidentiality of communications with their clients is well known not only to lawyers but also to members of the community. It is the assurance of confidentiality that encourages clients to disclose to their lawyer the most intimate details of their personal and business affairs. A client’s full and frank disclosure of all relevant circumstances ensures that the lawyer has all the necessary information to provide accurate legal advice.
