PRACTICE AND PROCEDURE
Message from the Professional Conduct Committee – Sensitive communications by email
Lawyers today almost always communicate by email, including about sensitive matters. Lawyers should be careful with the email addresses they are using when communicating with a party and consider whether the account is accessible or monitored by a third party (e.g. a personal partner, assistant or employee). When communicating with an individual for the first time in a matter, it is prudent to check whether an email address is private and suitable for use, and be satisfied of that (or that the person has had a reasonable opportunity to provide an alternate address) before communicating any personal or sensitive information.
