Conveyancing alert – revised cooling off notice
From Monday 1 June 2026, the new form of the cooling off notice must be used in a contract or option agreement, read more. The Contract for the sale and purchase of land 2026 edition includes the new cooling off notice, and the Law Society’s Digital Contracts Service via its FAQ page provides a document containing the new cooling off notice for the updating of contracts drafted using the 2022 edition. Practitioners may wish to consider doing an audit of any unexchanged contracts issued in the 2022 edition.

Consultation Draft Lodgment Rules Version 2.2
The Law Society made a submission with input from its Property Law Committee to the Office of the Registrar General on the Draft Lodgment Rules Version 2.2, which will mandate the lodgment of plan administration sheets and section 88B instruments in LRS Connect from 1 July 2026. The submission supported the continued transition to digital survey plans, however suggested clearer guidance on what constitutes “major” and “minor” alterations, to reduce requisitions, delays and costs, and improve registration efficiency.

Compulsory Drug Treatment Correctional Centre Program (CDTCC) eligibility expanded
Amendments to the Drug Court Regulation commenced on Friday 27 March 2026. The amendments expand CDTCC referring courts to all NSW District and Local Courts and extend eligible residential areas from 31 to 34 Local Government Areas to include Blue Mountains, Central Coast and Wollongong. The Law Society has been advised that, on 17 April 2026, the Australian Securities and Investments Commission published a Notice of Appointment of Liquidator in relation to Mudgee Private Rehab Pty Ltd, a private residential rehabilitation centre used for bail.
