Inquiry into supported decision-making in NSW
The Law Society of NSW, informed by its Elder Law, Capacity and Succession, Indigenous Issues, and Human Rights Committees, responded to the NSW Parliamentary Committee on Disability and Ageing’s inquiry into supported decision-making. The submission supports legislative reform to embed supported decision-making in law, building on prior NSW Law Reform Commission work. It emphasises alignment with the Commonwealth’s Aged Care Act 2024 and advocates for culturally safe frameworks co-designed with Aboriginal and Torres Strait Islander communities.
2025 Review of the Lifetime Care and Support Scheme
The Law Society made a submission to the Standing Committee on Law and Justice’s 2025 review of the Lifetime Care and Support Scheme, with input from its Injury Compensation Committee. The submission stressed the importance of sustaining long term care for people severely injured in motor accidents while keeping Green Slip premiums affordable, and encouraged scrutiny of the scheme’s financial sustainability, including levy growth, cost controls and administrative efficiencies. The Children’s Legal Issues Committee has prepared a summary of the recent amendments to the Children (Criminal Proceedings) Act 1987 (NSW) in relation to doli incapax, available here.
