Notification forms

The Legal Profession Regulation 2005 provides for a number of notifications to the Law Society Council under the provisions relating to Chapter 3 of the Legal Profession Act (Trust Accounts, Controlled Money and Investment Money).

The following forms will assist law firms to comply with the Regulation. 

Opening and closing accounts

Notification of opening a general trust account - Clause 74 (1)
Use this form to notify the Law Society Council of the opening of a general trust account. It should be noted that a general trust account can only be maintained with an approved authorised deposit taking institution (“Approved ADI”). See a list of approved ADI's.

Notification of closure of general trust account - Clause 74(5)
Use this form to close a general trust account or when your firm ceases to be authorised to receive trust money or ceases to engage in legal practice in New South Wales.

External examiners

Notification of appointment or termination of external examiner - Clause 93
Use this form to notify the Law Society Council on each occasion of appointing or terminating a designated person as an External Examiner.

Authorised signatories

Notification of appointment/termination of authorised signatories - Clause 74(3)(a)
Use this form to notify the Law Society Council of persons other than principals of the law practice who are local legal practitioners, who have been authorised to sign trust cheques or otherwise to effect, direct or give authority for the withdrawal of money from a general trust account or whose authorisation has been terminated.

Notification of authorised signatories as at July each year - Clause 74(3)(b)
Use this form to notify the Law Society Council in July of each year of persons, other than principals of your law practice who are local legal practitioners, who have been authorised to sign trust cheques or otherwise to effect, direct or give authority for the withdrawal of money from a general trust account.
