Barristers' applications
If you are a Barrister making an application for a NSW Practising Certificate as a Solicitor and Barrister, you are required to provide the following documentation:
- A completed Application form for a Practising Certificate & Membership of The Law Society of New South Wales.
- A completed Declaration of Good Standing Form.
- A Certificate of Fitness from the Bar Association dated within the previous 28 days. (Please note if you are the holder of a current Barrister’s Practising Certificate, you must surrender that certificate to the Bar Association).
- Details of admission in any other jurisdiction by submitting a Certificate of Fitness and Good Standing dated within the previous 28 days from the body issuing practising certificates in each of the jurisdictions.
- A brief resume of legal practice/work experience undertaken since your admission.
Please send these documents to the Law Society Registry together with payment for fees.
What conditions will be imposed?
Generally you will be issued with a non-principal’s Practising Certificate that is subject to:
- A period of Supervised Legal Practice, and
- A requirement to undertake a Practice Management Course.
If you have less than three years experience as a legal practitioner and you have not completed a Practical Legal Training course, you may be required to complete additional training courses such as the institutional phase of the Practical Legal Training course.
If you are intending to practise as a sole practitioner, unsupervised partner, legal practitioner director or solicitor on the record for a corporation, government department/instrumentality, you will require an unrestricted Practising Certificate. You will need to make an application to the Licensing Committee and the Committee will consider the application based on your experience & qualifications. Meetings of the Licensing Committee are held monthly.
