Alternative dispute resolution

The Law Society offers several programs in alternative dispute resolution (ADR) for the community, namely in mediation and early neutral evaluation.

Eligible members may seek appointment to the Law Society Mediators Panel and a list of arbitrators. This may entitle listing as a Mediator or Arbitrator on the Law Society's Find a Lawyer search facility.

The Law Society also offers a wide range of facilities to its members by which disputes, whether interpractitioner or between practitioners and clients, can be resolved without recourse to the Court system.

Mediation

Law Society Mediation Program – confidential, face-to-face mediation sessions conducted by experienced, highly-trained solicitors.

Law Society Mediators Panel – information about the Law Society Mediators Panel, including a list of selection criteria and how to apply.

National Mediator Accreditation – information about accreditation as a mediator under the Australian National Mediator Standards.

Arbitration

President's List of Arbitrators – information about the nomination and appointment of Arbitrators.

Determinations

Expert Determination – information about seeking an expert determination through the Law Society.

President's rulings – determinations about proposed actions or ethical disputes, such as conflicts of interest.

Conveyancing Dispute Resolution Scheme – receive determinations about conveyancing disputes from the Law Society’s Property Law Committee.

Collaborative Practice

Collaborative Law – information about how to enter a contract to resolve a dispute without resorting to litigation.
